Terms of Service

1. About these terms

By using yardxsale.com (the "Service") you agree to these terms. If you don't agree, don't use the Service. We may update these terms occasionally; we'll bump the "Last updated" date above and post a notice in-app for any material change.

2. Your account

• You must be 18 or older.
• One account per person. Don't share credentials; if you do, you're responsible for whatever happens on your account.
• We can suspend or terminate an account that violates these terms or appears to be abusive.

3. Content ownership

Listings indexed from third-party sites (Craigslist, EstateSales.NET, etc.) remain the property of their original posters. We display excerpts under fair-use indexing. Photos you upload via the submit flow remain yours — by uploading them you grant us a non-exclusive license to display them on the Service.

4. Acceptable use

You agree not to:

• Scrape or systematically harvest data from the Service. The API is rate-limited; bypass attempts result in account termination.
• Submit listings for illegal goods, weapons, or controlled substances.
• Submit spam, malicious links, or fraudulent sales.
• Use the Service to harass, stalk, or threaten any other user or any seller.
• Reverse-engineer the AI valuation system or attempt to extract its prompts.

5. AI features

Yardsale uses its own self-hosted AI models — we no longer rely on any third-party AI provider — to identify items in listing photos and provide pricing estimates. These estimates are based on public catalog data and recent sold-comp pricing — they are not appraisals and we make no guarantee of accuracy. Do not rely on AI valuations for purchases, insurance, or any legal purpose.

6. Paid subscriptions

Paid tiers are billed monthly via Stripe. You can cancel anytime from your account page; cancellation takes effect at the end of the current billing period. Refunds are at our discretion — email us if something went wrong and we'll usually make it right.

7. No warranty

The Service is provided "as is" without warranty of any kind. We don't promise the Service will be available, accurate, complete, or free from errors. Estate sales we link to may be canceled, fake, or mis-described by their organizers — verify before you drive there.

8. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of the Service — including lost profits, lost data, or wasted travel. Our total aggregate liability for any and all claims is limited to the amount you paid us in the 12 months before the event giving rise to the claim, which for free users is $0. Some jurisdictions don't allow the exclusion of certain liabilities (such as for gross negligence, willful misconduct, or fraud); to that narrow extent, and only where the law requires it, this limit may not apply.

9. Dispute resolution

Any dispute arising from these terms or the Service will be resolved by binding arbitration in the State of California under JAMS rules, except you may bring small-claims-court actions in your local jurisdiction. Class-action proceedings are waived.

10. Governing law

These terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws principles.
